The political crisis of Ukraine in 2014 and the subsequent secession of Crimea bear testimony to the fact that unless the boundaries of the concept of self-determination are better clarified in the post-colonial world, the continued political misuses of this concept will not surprise many any longer. Invoking the ambiguities surrounding self-determination from the standpoints of international law and constitutional law, this article contains an analysis of the legality of the secession of Crimea. To this effect, we will examine the cases of a similar nature preceding the secession of Crimea. Additionally, it will be discussed whether the case of Kosovo, as adjudged by International Court of Justice, could be of any precedential value for justifying the secession of Crimea.Key WordsSelf-determination, Territorial secession, Kosovo, International Law, Use of Force.}, keywords_fa = {حق تعیین سرنوشت,جدایی سرزمینی,کریمه,کوزوو,حقوق بین‌الملل,توسل به زور}, url = {https://lawresearchmagazine.sbu.ac.ir/article_56394.html}, eprint = {https://lawresearchmagazine.sbu.ac.ir/article_56394_5c52eb3bb4ab2b437af2edea7f38cc14.pdf} }
