بررسی مسئولیت بین المللی دولت ها در قبال اعمال گروههای تروریستی

چکیده

مسئولیت دولت در قبال اعمال گروههای تروریستی مسئله ای بسیار چالش برانگیز است. با بررسی مواد موجود در طرح مسئولیت دولتها برای اعمال متخلفانه بین المللی نمی‌توان همه موارد رابطه دولت و گروههای تروریستی را تحت شمول آن ها قرار داد. رابطه دولت با گروههای تروریستی به سه صورت است: اول آن که گروههای تروریستی تحت هدایت یا کنترل دولت هستند. دوم، گروههای تروریستی مستقل از دولت بوده، دولت تنها با آن ها همکاری و آن‌ها را مساعدت می-کنند، سوم آن که دولت نسبت به اقدامات گروههای تروریستی در سرزمینش نسبت به دولت های دیگر بی تفاوت است. طرح مسئولیت دولت های مصوب سال 2001 تنها پاسخگوی حالت اول است و در سایر حالت ها خلاء وجود دارد. برای پر کردن این خلاء نظرات مختلفی ارائه شده است که شامل نظریه مسئولیت مطلق یا جمعی، مسئولیت مبتنی بر معاونت، مسئولیت ناشی از اغماض و محاسبه خسارت و مسئولیت مبتنی بر سببیت می گردد. در این تحقیق تلاش می شود که هریک از این نظریات و نقاط ضعف و قوت آن ها بررسی شده و راه حلی نهایی ارائه گردد.

چکیده [English]

The responsibility of state for measures of terrorist groups is a challenging question. Considering all articles of the ILC Draft Articles on State Responsibility for International wrongful Acts can‌not include all aspects of co-operation between state and terrorist groups. Relation between state and terrorist groups is in three forms: first, terrorist groups are under control or instruction of state. Second, terrorist groups are independent from state and states only co-operate with and assist them. Third, states are indifferent to measures of terrorist groups done in their territory against other states. Draft Articles of Responsibility of States for International Wrongful Acts enacted in 2001 only respond to the first situation and there is a gap in other situations. Many opinions have been presented for filling this gap which include Theory of absolute or collective responsibility, Theory of Complicity, Condonation and accounting of damage theory and Theory of causation-based responsibility. In this article, it will be tried to study each of these theories and their weakness and strength points and to present final solution.
