«اصلاحگری» و «میانجیگری» به عنوان جایگزین روش‌های سنتی حل اختلافات مدنی- تجاری و امکان بکارگیری آنها در صنعت نفت

چکیده

چکیدهدر دهه‌های اخیر، غالب تجار بین‌المللی از رجوع اختلافات خود به دادگاه‌ها رویگردان شده و به داوری روی ‌آوردند. از دلایل این رویکرد می‌توان به سرعت بیشتر و هزینه کمتر داوری، خصوصی و محرمانه بودن آن و اختیار طرفین دعوی در تعیین تشریفات حل اختلاف اشاره کرد. لیکن، به مرور مزیت‌های داوری بر رسیدگی دادگاهی رنگ باخته و داوری شکل و شمایل رسیدگی دادگاهی به خود گرفت. با افزایش قاعده‌مندی و پیچیدگی داوری، سرعت رسیدگی کاهش و هزینه‌های داوری افزایش یافت. دلایلی از این دست باعث اقبال رو به فزونی تجار بین‌المللی به روش‌های حل اختلاف جایگزین ساده‌تر، سریع‌تر و ارزان‌تر از قبیل میانجیگری و اصلاحگری شده است. مقاله حاضر به بررسی مزیت‌ روش‌های اصلاحگری و میانجیگری نسبت به رسیدگی دادگاهی و داوری پرداخته و امکان کاربرد آنها برای حل اختلافات ناشی از قراردادهای نفتی و گازی را مورد بحث قرار می‌دهد و نتیجه می‌گیرد که با توجه به ویژگی‌های خاص صنعت نفت از جمله نیاز به حل سریع اختلاف و لزوم حفظ جو همکاری و دوستی در این قراردادهای بلند مدت، روش‌های اصلاحگری و میانجیگری می‌توانند جایگزین مناسبی برای روش‌های حل اختلاف داوری و رسیدگی دادگاهی به منظور حل اختلاف در قراردادهای نفتی و گازی بوده و به تکمیل پروژه‌ها و تداوم سرمایه‌گذاری‌ها در این صنعت خاص کمک نمایند.کلمات کلیدی: اصلاحگری – میانجیگری – داوری – حل و فصل اختلاف - صنعت نفت
