Energy Charter Treaty is a multilateral investment treaty that creates a legal framework for energy, transit and investment activities among members. This treaty paves the way for long- term cooperation among its members with the purpose of making sure the flow of energy is guaranteed from energy producing states to energy consuming ones. ECT is the only multilateral treaty that supports the investment in energy sector and provides guarantees for foreign investors against unilateral actions of the host state. This article reviews briefly the achievement of this treaty in the past twenty five years and by looking into the challenges, ECT faces 25 years after its acceptance, looks at the steps taken for modernizing it for future.
Among the most striking aspects of the ECT treaty is its settlement of Disputes mechanism, giving the right of bringing disputes by foreign investors against the host states in international forums.
