General validity conditions of contracts should be met to determine the validity of a smart contract. General validity conditions of a contract from Iran and the United States of America perspective consist of parties’ capacity, mutual agreement, consideration, and legitimacy of contract purpose. As described in this article, parties’ capacity normally does not examine in the routine procedure of smart contract conclusion, and it’s obligatory to ensure the complete capacity of parties by additional measures. Mutual agreements easily can be determined in smart contracts. Smart contracts can be concluded as reciprocal or nonreciprocal; and this article clarifies if there was no consideration in a nonreciprocal smart contract, it should be deemed as void in USA territory. Finally, if the purpose of a smart contract conclusion was illegal, undoubtedly that contract will be invalid in both Iran and USA territory.}, keywords = {Cyber Security,European Union,Cyber Security Agency of the European Union,cyber resilience,coherence theory}, title_fa = {امنیت سایبری اتحادیه اروپا: تهدیدات، فرصتها و اقدامات (از آغاز تا سال 2021)}, abstract_fa = {با رشد فناوری‌های نوین، ترویج استفاده از فضای سایبر و مواجۀ کنش‌گران سیاسی در نظام بین‌الملل با فرصت‌ها و تهدیدات آن، سیاست‌گذاری حوزه سایبر در دستور کار ویژه قرار دارد. یکی از این کنش‌گران سیاسی، اتحادیه اروپا است که به دنبال حضوری فعال و منسجم در حوزه سایبری در نظام بین الملل است. این مقاله به دنبال بررسی تهدیدات اتحادیه اروپا در حوزه‌ی سایبر، اقدامات اتحادیه در پاسخ به این تهدیدات و بررسی میزان انسجام میان مؤسسات، نهادها و آژانس‌های مرتبط با حوزه‌ی سایبر و تحلیل نقش آن‌ها در جهت مقابله با این تهدیدات است. سؤال اصلی این مقاله آن است که چگونه و با چه سازوکاری فرآیند سیاست‌گذاری امنیت‌سایبری اروپا در حال شکل‌گیری است؟ در پاسخ این فرضیه مطرح می‌شود که اتحادیه اروپا با شناسایی تهدیدات، اقداماتی از قبیل اسناد راهبردی، دفاعی و غیره را به عنوان نقشه راهی برای مقابله با آن تهدیدات منتشر کرده و به منظور پیشبرد آنان نیز آژانس، سازمان‌ و مؤسسه مرتبط را تأسیس کرده است ( به عنوان متغیر مستقل) تا به یک کنش‌گر منسجم حوزه سایبر در نظام بین الملل تبدیل شود ( متغیر وابسته). به منظور راستی آزمایی فرضیه از روش ردیابی فرآیند تاریخی- تحلیلی استفاده شده است. در این پژوهش نشان داده می‌شود که پس از حمله سایبری به زیرساخت‌های استونی، اقدامات اتحادیه اروپا چه از لحاظ کمّی و چه از لحاظ کیفی‌، افزایش یافته است که نشان از عزم اتحادیه اروپا در جهت تبدیل شدن به یک کنش‌گر منسجم در حوزه‌ی سایبر در سطح بین الملل است.}, keywords_fa = {امنیت سایبری,اتحادیه اروپا,آژانس امنیت سایبری اتحادیه اروپا,تاب‌آوری سایبری,نظریة انسجام}, url = {https://lawresearchmagazine.sbu.ac.ir/article_103081.html}, eprint = {https://lawresearchmagazine.sbu.ac.ir/article_103081_0483ad980c92444c5c48fbeba56b24d4.pdf} }
