Due to this multifaceted feature, such a legal regime is very complex. When the Treaty of Amity, Economic Relations, and Consular Rights between the United States and Iran was passed, it was not easy to conceive that such treaty could be resorted to in domestic courts against parties of the treaty. McKesson’s dispute against the Islamic Republic of Iran, despite of restrictions expressed in Algiers Accords and other political and legal obstacles, brings the question up as to how the McKesson Corporation could establish jurisdiction in the American courts and how the United States courts issued the verdict against Iran by resorting to the Treaty of Amity and Iran’s law. This article aims to discuss the jurisdiction of domestic courts in the United States to rule on actions of Iran’s government and private right of action against Iran by resorting to the Treaty of Amity and Iran’s law. It also considers obstacles in establishing domestic court jurisdiction based on the sovereign immunity principle and doctrine of foreign States’ actsKeywords: Treaty of Amity, Jurisdiction, Private right of action, Sovereign immunity, Doctrine of foreign States’ acts      }, keywords = {}, title_fa = {پرونده مککسون و صلاحیت دادگاه‌های ایالات متحده در رسیدگی به دعاوی علیه دولت ایران در چارچوب عهدنامه مودت و روابط اقتصادی و حقوق کنسولی}, abstract_fa = {نظام حقوقی حمایت از سرمایه‌گذاران در کشور میزبان، نظامی متاثر از حقوق بین‌الملل (معاهدات بین‌المللی، عرف بین‌الملل، اصول حقوقی و دکترین) از یک سو و حقوق داخلی کشورها و روابط سیاسی آن‌ها از سوی دیگر است. این نظام حقوقی به دلیل همین چند وجهی بودن، از پیچیدگی زیادی برخوردار است. زمانی که عهدنامه‌ی مودت و روابط اقتصادی و حقوق کنسولی بین ایران و دول متحده‌ی آمریکا در سال 1335 خورشیدی تصویب شد، تصور این که عهدنامه‌ی مودت به منظور جبران خسارت زیان‌دیدگان در دادگاه‌های داخلی علیه متعاهدین مورد استناد قرار گیرد، بعید بود. طرح پرونده مککسون علیه دولت جهوری اسلامی ایران، به‌رغم ممنوعیت طرح دعاوی به استناد بیانیه الجزایر و وجود موانع قانونی و سیاسی در طرح این‌گونه دعاوی، این پرسش را به پیش می‌کشد که چگونه شرکت مککسون توانست صلاحیت دادگاه‌های ایالات متحده آمریکا در رسیدگی به این دعوا را اثبات و سپس دادگاه به استناد عهدنامه‌ی مودت و تفسیر ارائه شده از حقوق ایران حکم به نفع آن شرکت صادر نماید.در این مقاله صلاحیت دادگاه‌های داخلی آمریکا در رسیدگی به دعاوی ناشی از اقدامات دولت ایران و حق اقامه‌ی دعوا علیه دولت ایران به استناد عهدنامه مودت و تفسیر ارائه شده در حقوق ایران و همچنین استناد به موانع اعمال صلاحیت دادگاه‌های داخلی به استناد اصل مصونیت دولت مستقل و دکترین عدم محاکمه و دادرسی عمل دولت‌ها مورد بررسی قرار می‌گیرد.                                                                                                                                                               Jurisdiction of United States Courts to Hear Disputes against the Government of Iran within the Context of the Treaty of Amity, Economic Relations, and Consular Rights                                                                                                                                                                                                                                                                                                    }, keywords_fa = {: عهدنامه مودت,صلاحیت,حق اقامه دعوا,اصل مصونیت دولت مستقل,دکترین عدم محاکمه عمل دولت‌ها}, url = {https://lawresearchmagazine.sbu.ac.ir/article_56153.html}, eprint = {https://lawresearchmagazine.sbu.ac.ir/article_56153_65d8c56b29e0bd9483a6659913af31f3.pdf} }
