In this article, the legal aspects of<br />government financial measures in times of crisis have been examined with<br />emphasis on the Covid pandemic. Explaining and analyzing the legal aspects<br />governing government actions requires pursuing this issue in constitutional law<br />and public finance law, and choosing different scenarios in this regard<br />(especially according to the theory of "necessity") will have a different response<br />in establishing laws and regulations. Also in this article, two general and<br />exceptional systems governing government expenditures have been examined<br />due to the occurrence of the crisis. چکیده<br /><br />شیوع کرونا در دنیا، مجالی برای دفاع مجدد از نظریۀ دولت و اقتدار در زندگی اجتماعی ایجاد نموده و باوجوداین، نقش و کارکرد دولت با توجه به کیفیت زندگی اجتماعی، متفاوت و اقداماتش موجد بار مالی خواهد بود. در این پژوهش، ابعاد حقوقی حاکم بر تدابیر مالی حکومت در زمان بحران با تأکید بر پاندمی کووید 19 مورد بررسی قرار گرفته است. تبیین و تحلیل ابعاد حقوقی حاکم بر اقدامات دولت، نیازمند پیگیری این موضوع در حقوق اساسی و حقوق مالیه عمومی است و انتخاب سناریوهای مختلف در این خصوص (به‌ویژه با توجه به نظریه «ضرورت»)، پاسخی متفاوت در استقرار قوانین و مقررات را خواهد داشت. همچنین در این مقاله دو نظام عام و استثنایی حاکم بر مخارج دولت با توجه به وقوع بحران مورد بررسی قرار گرفته است.<br /><br />کلیدواژگان:<br /><br />دولت، بحران، حقوق اساسی، وضعیت اضطراری، روابط مالی و محاسباتی.<br /><br /> <br /><br />این مقاله به سفارش «مرکز ملی تحقیقات حقوق سلامت» نگارش یافته است. https://lawresearchmagazine.sbu.ac.ir/article_102518_eaa98d224e9c0efbd7473ab927a8b682.pdf
