Personal academic freedom may be realized through institutional academic freedom. In other words, in addition to academic freedom of teachers, we can speak of freedom- independence of high education institutions from the hierarchy political and administrative authorities and at the same time, freedom- participation of teachers and academicians in the university affairs that promotes the affirmative or positive aspect of academic freedom. Additionally, providing a job security through security of tenure , recognizing a peculiar employment contract and due process for termination of contract are well known devices for protection of personal academic freedom. Academic freedom consisting in such components is nowadays not an ideal value, but the same as other human rights, is a legal duty on governments and this is a cause of conflict between them. This article is a research in descriptive- analytic method to find importance of academic freedom as a right in statute law and consider possibility of conflict of it with other human rights in different legal systems. آزادی آکادمیک در وهله اول یک حق- آزادی منفی است و در پی تدارک یک سپر دفاعی در برابر دخالت مراجع و نهادهای بیرونی به منظور حمایت از فعالیت هایی است که استادان (با هر درجه علمی) و دانشجویانِ نهادهای آموزش عالی(به هر نامی که خوانده شوند: دانشگاه، آکادمی، مدرسه...) در مقام آموزش، پژوهش و یادگیری موضوعات و مباحث علمی انجام می دهند. آزادی آکادمیک فردی گاه از قِبَل آزادی آکادمیک نهادی تامین می شود. به عبارت دیگر، می توان علاوه بر آزادی آکادمیک فردی دانشگاهیان، از آزادی- استقلال نهاد دانشگاه از سلسله مراتب اقتدار سیاسی و اداری سخن گفت و همینطور از آزادی- مشارکت دانشگاهیان در اداره امور دانشگاه که وجه مثبت یا ایجابیِ آزادی آکادمیک را تقویت می کند. همینطور تامین امنیت شغلی استادان از راه شناسایی حق تصدی شغل ثابت آکادمیک یا پیش بینی الگوهای استخدامیِ مخصوص برای استادان دانشگاه و یا روندهای شکلی منصفانه برای خاتمه قرارداد همکاری آنها با نهادهای آموزش عالی، اکنون به یکی از تمهیدات شناخته شده حقوقی برای دفاع از آزادی آکادمیک بدل شده است. آزادی آکادمیک با این اجزاء و مولفه ها، اکنون دیگر نه صرفا یک ارزش آرمانی بلکه به عنوان یک تعهد حقوقی، اجرای آن همانند سایر حقوق بشری بر عهده دولتها نهاده شده و همین امر چه بسا زمینه تعارض یا تزاحم اجرای آنها را در عمل فراهم می کند. این پژوهش به شیوه توصیفی- تحلیلی به تحقیق جایگاه آزادی آکادمیک و امکان تعارض آن با دیگر حق های بشری شاخته شده در قوانین کشورها می پردازد.
