The prerequisite for this consistence is the clarity of listed crimes subject to hadd and ta'zir and the requirement of this matter is the existence of a clear and precise criterion for separating the crimes subject to hadd and ta'zir from each other. In order to measure the validity of this stability and its requirements in the criminal system of hadd-ta'zir, first through an analytical approach, it is determined that the principle in punishments is to be ta'zir. Only in certain cases and in a disciplined manner this principle is abandoned. By a critical approach and regarding jurisprudential narrations and writings, the existing and probable criteria for considering hadd punishments are presented and analyzed. Accordingly many crimes that are considered as subject to hadd are challenged. Finally, it becomes clear that the dual hadd-ta'zir is not constant in terms of crime as it is commonly considered and with methodical ijtihad, changes in the list of crimes subject to hadd and ta'zir can be accepted. بنابر تلقی رایج، نظام کیفری دوگانه حد-تعزیر، از جهت جرایم مستوجب حد و تعزیر ثبات دارد. لازمه این ثبات، روشن و مشخص بودنِ سیاهه جرایم مستوجب حد و تعزیر است. و لازمه این مطلب، وجود ملاک روشن و دقیق برای تفکیک جرایم مستوجب حد و تعزیر از یکدیگر است. برای سنجش پشتوانه این ثبات و لوازم آن، در نظام کیفری حد- تعزیر، ابتدا با رویکردی تحلیلی، مقرر گشت که اصل در مجازات‌ها، تعزیری بودن است. صرفاً در موارد یقینی و به طور ضابطه‌مند می‌توان از ذیل این اصل خارج شد. سپس، با رویکردی انتقادی، و با عنایت به روایات و نوشته‌های فقهی، ضابطه‌های موجود و محتمَل برای حدانگاری کیفرها ارائه و تحلیل گشت، و از این رهگذر، حدی بودنِ بسیاری از جرایمی که در تلقی رایج، مستوجب حد قلمداد می شوند، به چالش کشیده شد. در نهایت روشن شد که دوگانه حد-تعزیر از جهت جرم، آن‌گونه که در تلقی رایج متصوّر است، ثبات ندارد و می‌توان با اجتهاد روشمند، تغییراتی را در سیاهه جرایم مستوجب حد و تعزیر پذیرفت. https://lawresearchmagazine.sbu.ac.ir/article_103662_b9259fc58b9faeed09dfd269bd2cf6a4.pdf
