On the other hand, the individualization of punishments as a necessary principle and its manifestation in judicial decisions requires tools, and the creation of a character file is one of the most basic of these tools. The personality file must contain a detailed and specialized report by psychology, psychoanalysis, psychiatry, and social workers, in which complete and accurate information about the psychological, social, economic, and cultural conditions of the accused or criminal. In Iran's legal system, unfortunately, despite the provision of this establishment in the Criminal Procedure Law as well as the Islamic Penal Code, the filing of personality files is done purely ceremonially and only for the purpose of classifying prisoners. At the same time, the effectiveness of the criminal trial process and the efficiency of this process with the help of filing a character file is not hidden from anyone. بزه به عنوان یک واقعیت انسانی و اجتناب‌ناپذیر همواره مورد توجه حقوقدانان و روانشناسان جنایی قرار گرفته است. از سوی دیگر فردی کردن مجازات‌ها به عنوان یک اصل ضروری و تجلی آن در تصمیمات قضایی نیازمند ابزارهایی است که تشکیل پرونده شخصیت از اساسی‌ترین این ابزارها است. پرونده‌ی شخصیت باید حاوی گزارش دقیق و تخصصی، متخصصان روانشناسی، روانکاوی، روانپزشکی و نیز مددکاران اجتماعی باشد که در آن اطلاعات کامل و دقیقی از شرایط روانی، اجتماعی، اقتصادی و نیز فرهنگی متهم و یا مجرم باشد. در نظام حقوقی ایران متاسفانه علیرغم پیش‌بینی این تاسیس در قانون آیین‌دادرسی کیفری و نیز قانون مجازات اسلامی، تشکیل پرونده شخصیت کاملا تشریفاتی و صرفا جهت طبقه‌بندی زندانیان صورت می‌گیرد. این در حالی است که تاثیرپذیری فرآیند دادرسی کیفری و کارآمد سازی این فرآیند به مدد تشکیل پرونده شخصیت بر کسی پوشیده نیست. <br /><br />واژگان کلیدی: پرونده شخصیت، بزهکار، روانشناسی، ابزارها، مرحله تحقیقات مقدماتی، فردی کردن مجازات https://lawresearchmagazine.sbu.ac.ir/article_103688_a9687ef36ab1ff9792e93d3455541c8b.pdf
