Journal Article 2016 09 18 Marriage as the lawful relationship between men and women is an acceptable social event in all human societies even though there are vast differences in how it is usually realized. It is based, in every society, on some principles which make it legal and if they are ignored the relationship changes to adultery. They present study seeks to explore Sharia laws in this relation and considering the famous tradition " There is marriage for all nations" explain the systematic framework considered for it in Islam. Two basic principles are discussed: a) systematic framework for marriage as the lawful relationship between men and women and for its rules and consequences and b) Formalizing marriage as the lawful relationship between men and women to make it in line with reasonable social norms. The study aims to show that Islamic rules are not strict inhibitors of marriage but actually conform to the basic principles acceptable in all other nations and ideologies. مقوله نکاح و پیوند مشروع میان زن و مرد در تمامی جوامع بشری با همه تنوّع فرهنگی، امری پذیرفته شده است. حقیقت یاد شده در هر نظام حقوقی بر پایه اصول و قواعدی است که اخلال بدانها پیوند مزبور را نامشروع ساخته موجب تحقق سفاح در برابر نکاح می گردد؛ در این جستجو برآنیم تا با تحلیل نگاه شارع به نهاد حقوقی نکاح و قاعدۀ فقهی «لکلّ قومٍ نکاح»، دو عنصر:" چارچوب منضبط در آثار و احکام" و "رسمیّت بخشیدن به آن، به دلیل هم سویی با هنجارهای عقلایی "- به گونه ای که در نگاه عرف آن جامعه، صریحاً دالّ بر نکاح تلقّی شود- را دو رکن اصلی نکاح بدانیم که- متناسب با فرهنگ ملل مختلف و با انضباط و اسباب ویژۀ هر قوم و آیین- به این رابطه، مشروعیّت می بخشند و اسلام نیز آن را معتبر می داند؛ چه، اهمیّت امر نکاح در اسلام، به معنای سخت گیری در اسباب ایجاد رابطۀ زوجیّت نیست و تنها تحقّق این دو عنصر، موجب اعتبار آن، به عنوان نکاح در میان تمامی اقوام و آیین ها، از جمله آیین اسلام، می گردد. https://lawresearchmagazine.sbu.ac.ir/article_57230_b6d6d70e13319c5b232f3b1018b18376.pdf
