This institution works as a the guarantee for not having the right of litigation or the lack of action, which is addressed in details in France’s civil procedure. However, there are only a few regulations about this institution in Iran’s civil procedure. But recognizing the La fin de non-recevoir as an instrument that can be effective in settling the problems based on its principles and contents, shows that most of the lawsuits and cases are not enforceable and must be ended by a conclusive decision at the beginning. Therefore the recognition of this institution in France dynamic legal system and also comparative analysis of Iran’s legal system in this matter and consideration of both countries’ legal procedure have been studied in this article. <br />  <br /><strong><em> </em></strong> <strong> </strong><br /> <em> ایراد عدم استماع دعوا نهادی است که به منظور دفاع در برابر ادعای طرف مقابل در حقوق ایران و فرانسه پیش‌بینی شده است. این نهاد ضمانت‌اجرای نبود حق طرح دعوا یا نبود حق اقدام است. در کد آیین دادرسی مدنی فرانسه به تفصیل دربارۀ حق طرح دعوا و ضمانت‌اجرای آن که غیرقابل استماع بودن ادعاست، صحبت شده است؛ درحالی‌که قانون آیین دادرسی مدنی ایران در این خصوص مقررات بسیار اندک و پراکنده‌ای دارد. از سوی دیگر، نهاد ایراد عدم استماع دعوا، ابزاری است که اگر دقیق شناسانده شود، می‌تواند در فیصله دادن سریع بسیاری از دعاوی کمک شایانی کند؛ چراکه توجه به اصول و محتوای این نهاد آشکار می‌کند که بسیاری از دعاوی قابل جریان یافتن نیستند و در همان ابتدا باید با صدور یک تصمیم قاطع مختومه گردند. به همین دلیل بازشناسی این نهاد در نظام حقوقی فرانسه به عنوان یک نظام حقوقی پویا و تطبیق مقررات آن با حقوق ایران، با توجه به رویۀ قضایی هر دو کشور، محور مطالعه در این مقاله قرار گرفته است.   </em><br />   https://lawresearchmagazine.sbu.ac.ir/article_57971_421decd64db2b0565dbe9ac3427f5623.pdf
