تعهدات مالی شرکت‌های نفتی بین‌المللی (IOC) در قراردادهای بالادستی صنعت نفت و گاز ایران موسوم به IPC

چکیده

در نظام مالی قراردادهای بالادستی جدید نفتی ایران موسوم به IPC به علت سنگین بودن سرمایه، شرکت نفتی بین‌المللی متعهد به حضور در کشور صاحب نفت و سرمایه‌گذاری کلان است. سابقاً در قراردادهای خدماتی موسوم به بیع متقابل پاداش‌ها به صورت ثابت و هزینه‌های سرمایه‌ای و غیرسرمایه‌ای دارای سقف بسته بودند که موجب تضرر شرکت‌های نفتی بین‌المللی و درنتیجه عدم تمایل به حضور و سرمایه‌گذاری شرکت‌های نفتی بین‌المللی در صنعت نفت ایران می‌شد؛ براین‌اساس، قراردادهای بالادستی جدید نفتی ایران با تغییراتی که در این بخش از قراردادها به وجود آورد، به دنبال جذابیت و جذب سرمایه‌گذاران خارجی است؛ با این توضیح که برخلاف قراردادهای خدماتی موسوم به بیع متقابل، سقف هزینه‌های سرمایه‌ای مستقیم و غیرمستقیم در این قراردادها باز هستند، ضمن اینکه پاداش سرمایه‌گذار در این قراردادها یک مبلغ ثابت نیست، بلکه با افزایش تولید، پاداش افزایش می‌یابد و این موضوع منجر به ترغیب و انگیزه بیشتر سرمایه‌گذار جهت استفاده از آخرین تکنولوژی‌های موجود در صنعت نفت و تولید بهینه و در نهایت موجب افزایش تولید و افزایش منفعت اقتصادی برای دو طرف می‌شود. در این مقاله تعهدات مالی شرکت‌های نفتی بین‌المللی در قراردادهای بالادستی جدید نفتی موسوم بهIPC  به صورت توصیفی – تحلیلی مورد بررسی قرار گرفته است

چکیده [English]

Due to the huge capital costs in the fiscal regime of new Iranian upstream oil contracts called IPC, the International Oil Company is committed to be present in the oil-possessed country and provide all the capital costs. Previously, in service contracts called buyback, remuneration was fixed and capital costs had a closed ceiling, which caused losses to international oil companies; thus International Oil Companies were reluctant to attend or invest in the Iranian oil industry. Hence, the changes in this section of the new Iranian upstream oil contracts were motivating and attracted foreign investors. In fact, unlike service contracts called buyback, capital costs and noncapital costs have open ceilings. In these contracts, not only no fixed amount of remuneration for the investor exists, but also the remuneration increases with production increase. This leads to the investor’s more motivation and incentive to apply the latest existing industrial technologies for optimum production and ultimately causes an increase in economic benefits for both parties. This Article studies the financial obligations of International Oil Companies in the new Iranian upstream oil contracts called IPC descriptively and analytically.
