تحول مفهوم دفاع مشروع: حقوق بین‌الملل و بازیگران غیردولتی

چکیده

تروریسم از جدی‌ترین تهدیدات علیه صلح است و داعش نیز به تعبیر قطعنامه های شورای امنیت تهدیدی جهانی و بی‌سابقه علیه صلح و امنیت بین‌المللی معرفی شده است. تاکنون در زمینه داعش یازده قطعنامه از سوی شورای امنیت صادر شده است. درباره مشروعیت توسل به زور درباره بازیگران غیردولتی مانند داعش که حقوق بشر و حقوق بشردوستانه را به طور جدی نقض کرده، موضع حقوق بین‌الملل در حال تحول است و مستقر نشده، چرا که رویکرد دیوان بین‌المللی دادگستری و نظرات جداگانه قضات دیوان، با رویکرد قطعنامه‌های شورای امنیت، بعض از اصحاب دکترین و با عملکرد برخی دولت‌ها متفاوت است. با اینهمه، حوادث بعد از 11 سپتامبر و نیز حوادث عراق و سوریه و جنایات هولناک داعش و سایر گروه‌های تروریستی، رفته رفته شورای امنیت ملل متحد را قانع می‌کند که از ظرفیت‌های حقوق بین‌الملل استفاده کند و دفاع مشروع (توسل به زور) در مقابل اقدامات تروریستی گروه‌های غیردولتی از قبیل داعش را مجاز بداند.

چکیده [English]

Terrorism is one of the most serious threats to peace, and ISIS (The Islamic State of Iraq and the Levant) has been introduced as a global and serious threat to international peace and security, as determined by Security Council. The legitimacy of use of force against non-state actors such as The Islamic State of Iraq and the Levant (Known as ISIL) which has seriously violated human rights and humanitarian rights is evolving and not yet well established. In fact, the position of ICJ (International court of justice) and individual opinion of ICJ judges is different from the resolution of Security Council, doctrines and state practice. However developments after 9/11 ( 2001 ) and also the situation in Iraq and Syria and serious crimes by ISIS and other terrorist groups has gradually convinced the Security Council to consider the legitimacy of use of force and self-defense against terrorist activities of non-state actors such as ISIS.
