نقش دموکراسی در مشروعیت بخشی سیاست گذاری و فرآیند کیفری

چکیده

.در سیاست‌گذاریِ دموکراتیک خواست های شهروندان در هنجارگذاری کیفری مورد توجه قرار می گیرد. مشروعیت تدابیر کیفری از طریق هویت بخشی به شهروندان و حفظ آزادی های آنان صورت می پذیرد. در یک نظام مردم سالار شهروندان بیشترین مشارکت دموکراتیک را در فرآیند کیفری دارند. در این پژوهش به ‌صورت توصیفی-‌تحلیلی از طریق اطلاعات کتابخانه‌ای در پرتو سه اصل نمایندگی، حقوق شهروندی، تحدید قدرت به این سوال پاسخ داده می شود، برای سیاست گذاری کیفری عادلانه که از مقبولیت حداکثری برخوردار باشد، خواسته شهروندان چه جایگاهی دارد و تا چه میزان به اراده عموم شهروندان باید توجه شود؟ برآیند پژوهش حاضر این است که اصول دموکراسی در هرجامعه برحسب اینکه تا چه میزان مفهوم سازی شود، بر نوع و نحوه سیاست های کیفری تاثیرگذار است. دموکراسی با جلب رضایت شهروندان و فرآهم آوردن مشارکت دموکراتیک ضمن تاثیر گذاری بر جرم انگاری ها می تواند زمینه پاسخ دهی کیفری عادلانه را در جامعه فراهم آورد. توجه به اراده شهروندان در سیاست گذاری مردم سالار سبب می شود، پاسخ‌های کیفری در پرتو مفاهیم حقوق شهروندی باز تعریف شود و جرم انگاری و کیفرگذاری منطیق با فرهنگ و تمدن جامعه صورت پذیرد. یافته ها در این پژوهش مثبت این حقیقت است که نتیجه قهری استقرار مفاهیم دموکراسی در جوامع ضرورتا برقراری پاسخ های کیفری انسانی نیست و سیاست گذاران در پاره ای از موارد با انحراف از مفاهیم دموکراتیک نسبت به برقراری پاسخ های سخت گیرانه اقدام می کنند.

چکیده [English]

In democratic policymaking, the demands of citizens in Criminal Normalization are taken into
consideration. The legitimacy of criminal measures is achieved through the identification of citizens and
the protection of their freedoms. In a democratic system, citizens have the most democratic participation in
the Criminal process. In this research, this question is answered in a descriptive-analytical way through
library information in the light of the three principles of representation, citizenship rights, and limitation of
power. What is the position of citizens' demands for a fair criminal policy that is maximally acceptable and
to what extent should the will of the general public be taken into account? The result of the present study
is that the principles of democracy in any society, in terms of the degree to which it is conceptualized, affect
the type and manner of criminal policies. Democracy by providing citizens' satisfaction and providing
democratic participation while influencing criminalization can provide the basis for a fair criminal response
in society. Paying attention to the will of citizens in democratic policy-making causes criminal responses
to be redefined in the light of the concepts of civil rights, and criminalization and Sentencing to be carried
out following the culture and civilization of society. the findings in this study are positive this fact, That
the coercive result of establishing the concepts of democracy in societies is not necessarily the establishment
of humane criminal responses, and in some cases, policymakers deviate from democratic concepts to
establish strict responses
