Article 1 of the 1949 Geneva Conventions provides that the High Contracting Parties undertake to respect and to ensure respect for the present Convention in all circumstances. The phrase "Ensure Respect” which was not initially considered a controversial term and was included in the body of the Geneva Conventions without any special discussion, became a controversial term over time, so that in the International Committee of the Red Cross commentary into these conventions Published in 2016, "Ensure Respect" is interpreted as the commitment of other non-participating states in an armed conflict to take action to ensure compliance by the parties to the Geneva Conventions. For decades, however, the term "Ensure Respect" has been applied to the implementation of the provisions of the Geneva Conventions by each Contracting State and in the territories and territories under its Jurisdiction. In this article, the author seeks to use the library method and review the documents related to the creation of the Geneva Conventions as well as the Additional Protocols and according to the doctrine in international law, the correct interpretation of the phrase "Ensure Respect" mentioned in the said article.
