The issue of children's health, as the richest social capital of the present age, is considered very important. The right to health, as one of the human rights, has various dimensions, including mental health, which means benefiting from positive personality-behavioral characteristics and the absence of mental and psychological problems. Juvenile delinquents also have this right as one of the most vulnerable human groups, and the differential criminal justice system, which aims to rehabilitate this group, is bound to pay attention to it. In fact, since the foundation of this system's support and treatment programs is based on identifying risk factors and implementing supportive measures, identifying the mental and psychological problems of delinquent children and then measures to reduce their effects are included in this section. In addition, paying attention to the right to mental health based on human rights strategy is considered essential in the context of juvenile delinquency; also, paying attention to the mental health of children and adolescents is one of the main axes of differentiation of this system and predicting the structure, actors and supportive responses. In other words, the juvenile criminal justice system has the capacity to recognize the right to mental health of this group. The employment of trained actors, the presence of a counselor in the response process, the right to file a personality case, the individualization of the responses, and the presence of the family at the response stage are examples of existing capacities
