فقدان رقابت کارآمد در معاملات عمومی و شکست بازار

چکیده

حقوق معاملات عمومی و حقوق رقابت به عنوان دو مجموعه مقررات اقتصادی، تعاملات گسترده‌ای با هم داشته و هر یک می‌تواند به توسعه و کارایی دیگری کمک کند. دولت به عنوان یک خریدار غالب و یا انحصاری می‌تواند باعث اختلال رقابت در بازار شود و در نتیجه به علت تحمیلِ قیمتِ خارج از تحمل بازار در دراز مدت بر تعداد تأمین‌کنندگان کالا و خدمات و کیفیت آنها اثر منفی بگذارد و دولت را از دستیابی به ارزش پول در طرح‌های آتی محروم نماید. وجود این خریدار قدرتمند در بازار منافع عرضه کنندگان را به خطر می اندازد و در بلند مدت می تواند منجر به انحلال یا ادغام آنها شود. همچنین باعث می شود قیمت نهایی محصولات و خدمات برای سایر خریداران بالاتر رود. بنابراین وجود یک خریدار غالب در بازار نه تنها به تأمین کننده بلکه به سایر مشتریان او نیز آسیب می‌زند. این پژوهش قدرت دولت را به عنوان یک خریدار غالب و گاه انحصاری نقد کرده و با ارائه یک مدل تحلیلی از تأثیر خریدار دولتی به عنوان یک خریدار غالب بر قیمت نهایی محصول در بازار به این نتیجه می‌رسد که تأمین کنندگان برای جبران کسر قیمت/سود فروش محصولات خود به دولت یا حذف از مناقصه، قیمت خود را برای سایر خریداران بالاتر می‌برند و منجر به اختلال جابجایی قیمت‌ها و در نتیجه شکست بازار می‌شوند. بنابراین راه‌حل‌هایی از جمله انعطاف‌پذیر کردن مقررات خرید عمومی و همچنین کوچک‌کردن قراردادهای اعطایی پیشنهاد شده است.

چکیده [English]

Abstract
Both public procurement and competition law represent two of the basic components of market regulation and affect highly on the efficiency and development of economics. Economics has always played a more significant role in competition law while public procurement regulations and practices are a source of market failure. By their inflexible price policies, they generate a big negative impact on market dynamics and impose an efficiency loss on society. The government as the main buyer can cause monopsony and their action in the market can detract from perfect competition. The public procurement regulation may remove a number of suppliers from public market. Whilst government may benefit in the short term from cost-saving and low prices, by these reductions of opportunities and imposing prices on suppliers, the long term effects can be destructive and worse market conditions for fringe buyers—both in terms of reduced variety and (in the long run) in higher prices. In order to justify the view that public procurement is a source of potential distortion in market competition, this research has criticized the monopsony of government and its effects on suppliers and other smaller buyers.
