The screening of the eligibility of candidates in the election by the guardian Council: A different approach
Asadollah YAVARI (Assistant Professor of Law, Shahid Beheshti University)
Abstract
Among the issues and different levels of supervision in an election, scrutiny the candidates’ competence is very important. A regulated and impartial system of supervision, on one hand, guarantees pluralism in thoughts and the presence of different political groups, as well as equal electoral competition. On the other hand, this supervision prevents the presence of people who do not have the legal required conditions and an unreasonable increase in the number of candidates (which would put the voters in trouble). Despite of the acceptance of the supervision principle in Iran, there are political controversial discussions on candidates’ competence supervision except in the first rounds of presidential and parliament elections. Most of the criticisms are about supervision reference i.e Guardian Council. While, it seems that the challenging point in this respect concerns to some political, beliefs and moral factors of competence for candidates. Indeed, as the generality and ambiguity and maybe biased for special tendency of these conditions, it is possible that the supervision reference’s taste will be applied and notable thoughts, people and groups which are different be rejected in the competition.
